These terms apply to your use of the Cottesloe General Store website and to any purchase you make through it. In these terms, “we”, “us” and “our” mean Cottesloe General Store, and “you” means anyone using our website or buying from us online. By using our website or placing an order, you agree to these terms. If you don’t agree, please don’t use the site.

Using our website

You may use our website for personal, non-commercial purposes only. You agree not to:

• use the website for any unlawful or fraudulent purpose
• interfere with the website’s security or try to gain unauthorised access to any part of it
• upload or transmit viruses or any other harmful code
• copy, scrape or reproduce any part of the website without our written permission

We may suspend or restrict access to the website at any time, including for maintenance or updates.

Accounts

If you create an account, you’re responsible for keeping your login details secure and for all activity under your account. Let us know straight away if you think someone has accessed your account without permission.

Products

We do our best to show our products, colours and details accurately. Colours may look slightly different depending on your screen, and minor variations in print or embroidery placement are a normal part of how our merch is made. All products are subject to availability.

Pricing

All prices are in Australian dollars and include GST. Shipping costs are shown at checkout. We may change prices at any time, but changes won’t affect orders that have already been confirmed.

If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after we’ve sent an order confirmation.

Orders

When you place an order, you’ll receive an email confirming we’ve received it. This confirmation does not mean your order has been accepted. Your order is accepted when we dispatch it or notify you that it’s ready for pickup.

We may decline or cancel an order for any reason, including if an item is out of stock, if there’s an error in the price or description, or if we suspect fraud. If we cancel an order you’ve paid for, we’ll refund you in full.

Payment

Payment is taken at checkout through our secure payment providers. We do not store your full card details. Your order will be processed once payment has been received and approved.

Shipping and pickup

We ship within Australia. Standard shipping is $10 and is free on orders over $100, and express shipping is $15. Free pickup is available from our store during opening hours. Full details are in our Shipping Policy, which forms part of these terms.

Risk in the products passes to you on delivery or when you collect your order. Ownership passes to you once we’ve received full payment.

Returns and refunds

We don’t offer refunds or exchanges for change of mind. Faulty, damaged or incorrect items are covered by our Return & Refund Policy, which forms part of these terms.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.

Intellectual property

All content on this website belongs to Cottesloe General Store or is used with permission, including our designs, logos, artwork, photography and text. You may not copy, reproduce, sell or use any of it without our written consent.

Third-party links

Our website may link to other websites, such as our Instagram. We’re not responsible for the content or practices of those sites.

Privacy

We collect and handle your personal information in line with our Privacy Policy, which forms part of these terms.

Limitation of liability

To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of our website or our products. This includes loss of profits, data or opportunity. Where our liability can’t be excluded but can be limited, it is limited to replacing the goods, repairing them, or refunding the price you paid, at our choice.

This doesn’t affect any rights you have under the Australian Consumer Law that can’t be excluded.

Indemnity

You agree to indemnify us against any loss, damage or cost we incur because you breached these terms or used our website unlawfully.

Governing law

These terms are governed by the laws of Western Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Western Australia.

Changes to these terms

We may update these terms from time to time. Any changes will be posted on this page with an updated date and will apply to orders placed after that date.
